Abstract

Personal data become one of the important basic resources of the Big Data industry development, and its demand is rising. The personal data is misused and the black market is widespread and rampant,which makes the personal data privacy protection is growing. Facing with the conflict between supply and demand, the technology, industrial and social development of the Big Data era urgently needs to improve the personal data privacy regulation.

Firstly, the overall design of the privacy regulation was conducted, the first study conducted is the overall design of the privacy regulation, which made a clear privacy regulation goal, mechanism constitute and its intrinsic relationship; Secondly, the three main mechanisms were studied, that is, the marketing authorization mechanism,the privacy disclosure reporting mechanism and the traceability mechanism. The active mechanism was analyzed and a specific mechanism was designed. Finally, on the basis of the above studies, the personal data privacy regulation policy recommendations were raised. This study hopes to balance the industrial innovation and the privacy protection, to provide the theoretical guidance for promoting the healthy development of the Big Data at the same time.
